2007-M-061                Mark Alan Stutelberg, petitioner, Appellant, vs. State of Minnesota, Respondent.

The Court reversed the district court’s summary dismissal without a hearing of the denial without a hearing of Stutelberg’s post-conviction appeal of his conviction for the premeditated first-degree murder of his girlfriend in1992 after she had testified against him in his 1980 murder of a drug dealer during a robbery.

Here, the Court held that the district court abused its discretion by summarily denying appellant’s petition for post-conviction relief and motion for an evidentiary hearing where the petition, files, and records of the proceeding do not conclusively show that appellant is entitled to no relief
