2008-M-076             Randy Ronell Lynch, petitioner, Appellant, vs. State of Minnesota, Respondent.

In 1997, the Hennepin County District Court convicted Randy Ronell Lynch of first-degree felony murder.  Following his conviction, Lynch directly appealed to our court in 1999, arguing that the district court erred when it denied his pretrial motion to dismiss the grand jury’s first-degree murder indictment against him.  We affirmed his conviction.  Lynch subsequently petitioned for post-conviction relief, again claiming errors in the grand jury proceedings.  The post-conviction court denied the petition without holding an evidentiary hearing, and Lynch now appeals.  We affirm.

Because the petitioner did file or could have filed all of his current appeals on this current petition for post-convictions relief during his earlier appeals, the Court rejected this petition under the precedent of Knaffla.
