2008-M-071             Michael Wayne, petitioner, Appellant, vs. State of Minnesota, Respondent.

Mona Armendariz was murdered in 1986.  Appellant Michael Wayne was convicted of the murder in 1987.  On direct appeal,  The Court affirmed both his conviction and the denial of his first petition for post-conviction relief in 1989.  The Court denied his second petition for post-conviction relief in 1993.  The Court denied his third petition for post-conviction relief in 1999.  He filed a federal habeas corpus writ that was rejected in 1996.   He filed this sixth appeal in 2006. 

Because the petitioner did file or could have filed all of his current appeals on this current petition for post-convictions relief during his earlier appeals, the Court rejected this petition under the precedent of Knaffla.
